This document establishes the General Contracting Conditions of the website www.lelen.es, which aims to purchase products from Isabel Fernández Vilar (hereinafter, LELÉN), with CIF 76827473K and whos registered office is at Calle Pintor Laxeiro 33, 1º A - 36500 Lalín (Pontevedra) by those natural or legal persons (hereinafter, contracting person or user) who express their willingness to acquire the products that are made available to them in the store on the website www.lelen.es through the request made by electronic means, specifically, via the internet through that website owned by LELÉN.
These General Contracting Conditions are permanently displayed on the website www.lelen.es, owned by LELÉN, and all users can file, print and therefore be previously informed of the conditions under which the contracting of the store products (hereinafter, the product).
Likewise, these General Conditions are reiterated together with a summary of the specific request - specific product / s contracted / s, cost with indication of taxes if applicable, shipping costs, etc. - for their express acceptance of the contracting person, by clicking on "I have read and accept the terms and conditions", each time a specific request is made through the website.
It is not technically possible that the contracting person can finalize the request without the acceptance of these General Conditions. In order for the contracting person to be able to make this acceptance and, therefore, make the request, they must provide their data when ordering at www.lelen.es, at which time they accept these Conditions and the Website's Privacy Policy.
The contracting person, by accepting these Conditions, gives his/hers express and unreserved consent for LELÉN to carry out the collection operations necessary for the acquisition of the product that he/she hires, expressly authorizing LELÉN to make the collections in the payment methods that he/she has selected. , or entered from the secure area enabled for this purpose, in accordance with the regulations on payment services.
The present General Conditions together with the specific request made through the Internet by the contracting person - also called “Particular Conditions” - configure the content of the contract between LELÉN and the contracting person who declares to have sufficient capacity to contract and have read, understood and accepted these conditions.
LELÉN, at the time of contracting and within a period not exceeding twenty-four hours, will send the confirmation of the order placed to the email address associated with the contracting person's account.
The contracting person will permanently have these General Conditions on the website. Any subsequent modification of these General Conditions will be clearly displayed in an easily accessible place on the website www.lelen.es. All the aforementioned documentation may be printed and filed by the contracting person, and may be requested at any time from the Customer Service Department, via email sent to info@lelen.es or by calling the telephone number 886096402.
Any request for information, or a claim that is deemed pertinent, may be submitted to the Customer Service at the address identified in the previous paragraph. The Service will acknowledge receipt of the claim submitted by forwarding the relevant supporting document - with the corresponding identification key - to the email address that must be provided to the Customer Service to process the claim.
By this contract, LELÉN undertakes to deliver to the contracting person the product that they have requested through the website www.lelen.es in exchange for a certain price and in accordance with the conditions established in this document.
Product delivery
LELÉN undertakes to deliver the product in perfect condition to the address indicated by the contracting person on the order form, which contains the specific conditions that are attached to these general conditions. LELÉN will not be responsible for the errors caused in the delivery when the data entered by the contracting person in the order form do not conform to reality or have been omitted.
HEADDRESSES OF GUEST, BRIDE AND PETIT:
The delivery time for these products is 20 to 25 business days from when the order is placed online and it is delivered to the indicated address.
They are orders that, although they are available online, are made to measure and handmade for each client.
The shipping costs for the Peninsula are € 7 for any type of product which amount is less than € 90. If they exceed this amount, the shipping costs will be free.
COLLECTION DRESSES PARTY AND BRIDE:
The estimated delivery time for these products is 15 to 20 business days in the Peninsula. Outside Spain, the estimated delivery time is 20 to 25 business days. We do not have stock, each garment is made to order. It is one of our mottos, slow and sustainable fashion.
The shipping costs outside Spain of products from the collection of party and wedding dresses should be consulted at ventas@lelen.es
Shipping costs are free in Peninsula for collection orders for party and wedding dresses.
LELÉN's responsibility
LELÉN will in no case be responsible for:
- Errors, delays in access by the contracting person when entering their data in the order form, the slowness or impossibility of order confirmation or any anomaly that may arise when these incidents are due to problems in the Internet, causes of fortuitous event or force majeure and any other unforeseeable contingency unrelated to LELÉN's good faith. In any case, LELÉN is committed to solving any problems that may arise and offering all the necessary support to the contracting person to reach a quick and satisfactory solution to the incident.
- Errors or damages caused by an inefficient and bad faith use of the product by the contracting person.
- The non-operability of the email address provided by the contracting person to send the order confirmation.
Exchanges and returns
Guest, bride and petit headdresses, custom designs
- Returns: as it is a custom product, no returns are accepted.
- Changes: There will be up to 14 days from the receipt of the product to make some kind of modification to the headdress. The cost of shipping is borne by the customer.
Free return or exchange in the LELÉN studio: if you are not satisfied with your online purchase, you have 14 days after receiving your order to exchange it for another size or request a return. Request an appointment in our studio located in Lalín (Pontevedra) and deliver the item you want to change or return. If it is a return, we will give you a coupon for the value of your purchase so that you can buy any product from our online store valid for one year. It is essential that the product is in perfect condition, without signs of use and bears the label with which it was delivered.
Home pickup: You have 14 days to request home pickup and we will send a courier to pick up your package or to exchange it for a different one. Request the collection or change at ventas@lelen.es. Package items securely, in their original packaging, if possible. The carrier will go to the address you provide us to pick up the product, or to make the change for the new one.
The price of this service in the peninsula is free for an exchange and € 7 for a return. It is essential that the product is in perfect condition, without signs of use and bears the label with which it was delivered.
Changes: In case you prefer another size or model, you can request it at ventas@lelen.es
Changes and returns outside Spain: in case of change, the customer will be responsible for the shipping cost of the Lelén product.
Returns conditions
In making exchanges and returns you should know that:
- The returned items must be in the same conditions as when you received them, otherwise it will be evaluated if the change or the return of this is appropriate.
- As soon as we receive your package, we will check the condition of the items and we will make the change of size or the sending of the coupon for the value of the amount.
- The coupon will be sent to your email within 1-3 days from receipt of the product. LELÉN reserves the right to reject returns reported or sent after the deadline or items that are not in the same condition as received or that show signs of wear.
LELÉN does not make a refund, but gives a coupon for the value spent, since we are a small company that does not have stock, each item is made especially for you on request. The coupon is valid for one year and can be used to spend on any item for sale online and / or custom order.
The contracting person, before signing the delivery of the order must check that the product is delivered in perfect condition, if he/she agrees at the time of delivery it is understood by both parties that the product was delivered correctly and, therefore, the possible deterioration occurs after delivery.
The contracting person expressly waives to claim any contractual or non-contractual liability for possible damages or losses derived from what is stated above in this clause. In any case, LELÉN's responsibility if it fails to comply with the provisions of this agreement under the terms of these general conditions will be limited to the refund of the amount that, if applicable, the contracting person could have paid in relation to the product and always after return by the contracting person of the product in question.
The contracted product has the guarantee of conformity provided in the Law. If the product is not in accordance with the contract, the contracting person may choose between demanding the replacement of the product, or, where appropriate, the reduction of its price or resolution of the contract, in the legally established terms.
Payment
The contracting person agrees to pay the amount for the product actually requested in the amount and manner established in these Conditions.
Amount
he remuneration for the product actually requested by the contracting person will be that indicated on the website and that which appears in the specific request of the contracting person at all times (except in case of typographical or manifest error); requests that will constitute the particular conditions of the order. The price of the product that appears on the website is always indicated in euros with taxes included.
In the event of an error in the price of the product requested by the contracting person, LELÉN will inform you as soon as possible and give you the option of reconfirming the order at the correct price or canceling it. In the event that the contracting person cannot be contacted.
The complete final price will include: the taxes or fees, the amount of the increases or discounts that are applicable to the offer and the additional expenses - for example, those associated with transport, means of payment, etc. - that are passed on to the contracting person, which will be expressly accepted by the contracting person.
LELÉN will issue the invoice corresponding to the contracted product detailing all the concepts that comprise it. The contracting person expressly consents to the transmission of the invoice electronically, to the email address provided when processing the order. At any time, the contracting person can communicate his desire to receive invoices on paper, by means of a communication addressed to the Customer Service Department.
Payment Methods
The contracting person must pay the amount corresponding to the contracted product through any of the payment methods and procedures available on the LELÉN website, only accepts payments made through Paypal and bank transfer. Card payment is being implemented.
The additional costs associated with the selected payment methods must be paid and confirmed independently in the terms indicated on the website. PayPal has additional associated costs.
Withdrawal
The contracting person, who has the status of consumer in accordance with current legislation, can withdraw from the contract made at www.lelen.es, without the need for justification, within fourteen calendar days from the day of delivery of the last of the products included in the contract.
The hiring of those products that are made according to the specifications of the contracting person and clearly personalized will not be subject to withdrawal.
To exercise the right of withdrawal, the contracting person must notify their decision to withdraw from the contract through an unequivocal statement to: LELÉN, at Calle Pintor Laxeiro 33, 1º A - 36500 Lalín (Pontevedra), or info@lelen.es, indicating that the contract is terminated and providing the following information: order reference, date of receipt, name and surname of the contracting person and their address. You can also use the model form provided in the current regulations on consumer and user defense. If the withdrawal is presented on paper, it must be duly signed by the contracting person. To meet the deadline, it is enough that the notification is sent before it expires.
In the event of withdrawal by the contracting person, LELÉN will refund all payments received, including - where appropriate - delivery costs (except for additional costs resulting from the contracting person choosing a delivery method different from the less expensive modality of ordinary delivery that LELÉN offers), without any undue delay. Such refund will be made using the same means of payment used for the initial transaction, unless otherwise expressly agreed. The contracting person will not incur any expenses as a result of the refund. LELÉN may withhold the refund until the products have been received or until proof of return is presented.
The contracting person must return or deliver the products directly to LELÉN, at Calle Pintor Laxeiro 33, 1º A - 36500 Lalín (Pontevedra) without any undue delay and, in any case, no later than fourteen calendar days from the date you communicate your decision to withdraw from the contract. The deadline will be considered fulfilled if you return the products before the deadline has expired. The contracting person must bear the direct cost of returning the products. The cost of the return will depend on the transport and / or courier company selected by the contracting person to make the return of the product.
Responsibility of the contracting person
The contracting person assumes all risks of deterioration, impairment, damage and loss of the product from the moment it has been made available to him by the third party who, on behalf of LELÉN, delivers the requested product.
The contracting person will be responsible for the decrease in value of the products resulting from handling other than that necessary to establish the nature, characteristics and, where appropriate, the operation of the products.
The contracting person agrees to check the good condition of the product before the third party who, on LELÉN's behalf, delivers the requested product, a check that will be carried out prior to signing the proof of delivery.
LELÉN and the contracting person may terminate this contract for any of the causes established in the laws and in particular for the breach of these General Conditions. The termination of the contract may be exercised by contacting the other party at: the postal address provided by the contracting person when contracting the service, and at the LELÉN address, duly identifying the contract to be resolved.
LELÉN informs that the own contents, programming and design of the website www.lelen.es, are fully protected by copyright, all reproduction, communication, distribution and transformation of the aforementioned protected elements being expressly prohibited except with the express consent from LELÉN.
LELÉN may use external sources for the elaboration of its contents on certain occasions and / or establish links or hyperlinks to articles or information from third parties, always citing the source. The legitimate owner of the copyright of this information thus included may request at any time the removal of said references.
The data provided by the contracting person in accordance with these General Conditions will be treated in the terms stipulated in the Privacy Policy published on the website.
These general conditions are governed by Spanish law. The Courts of Lalín (Pontevedra) are competent to resolve any controversy or conflict arising from these general conditions, the contracting person expressly renouncing any other jurisdiction that may correspond to him. Consumers can use the platform for out-of-court settlement of disputes, derived from contracts of sale or provision of services concluded online, accessible through the following link: http://ec.europa.eu/odr.
In the event that any clause of this document is declared null, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these conditions. This contract is made only in Spanish. LELÉN may not exercise any of the rights and faculties conferred in this document, which will not imply in any case the waiver thereof unless expressly acknowledged by LELÉN.
